What Every School-Based BCBA Needs to Know About Education Code
Apr 10, 2025
As a BCBA working in schools, you’ve probably felt the tension between what you can do ethically and what you’re allowed to do legally. You’re not alone—and that’s where understanding Education Code becomes a game-changer.
This isn’t just legalese. It’s the key to advocating effectively, protecting your license, and ensuring your behavior support plans hold up in IEP meetings and beyond. Whether you’re drafting FBAs, consulting on IEPs, or training staff, your work intersects with the law every single day.
At our Behavior Change in Schools Conference, the session “Education Code for BCBAs” breaks it all down—without the legal jargon. You’ll learn:
-
The differences between IDEA, ADA, and Section 504—and why they matter to your role
-
What your responsibilities are in the IEP process
-
How to document behavioral services in legally sound ways
-
How to navigate conflicts between educational law and the BACB Code of Ethics
Enjoy this Free Session Preview: Understanding the “Big 3” Laws That Guide School-Based Services
When you're navigating school-based services as a BCBA, three major laws shape your scope, your language, and your approach:
-
IDEA (Individuals with Disabilities Education Act) – Requires that eligible students with disabilities receive a Free Appropriate Public Education (FAPE) in the Least Restrictive Environment (LRE). BCBAs often support this through IEP involvement, data collection, and behavior plans.
-
Section 504 of the Rehabilitation Act – Protects students with disabilities from discrimination and ensures accommodations. While not as robust as an IEP, a 504 Plan still requires behavior support when a disability interferes with learning.
-
ADA (Americans with Disabilities Act) – Extends nondiscrimination protections beyond schools—think field trips, transportation, and extracurriculars. It can also come into play when working with general education staff or administrators.
Key takeaway:
If you’re providing behavior support in any school setting, you’re working under these laws—whether or not you realize it. The more familiar you are, the stronger your advocacy and documentation will be.
